Renting Homes (Fees etc.) (Wales) Act 2019

A Welsh Government Bill, introduced by Rebecca Evans AM, the then Minister for Housing and Regeneration. On 6 January 2019, the First Minister authorised Julie James MS, Minister for Housing and Local Government, as the new Member in Charge of the Bill. The Business Committee remitted the Bill to the Equality, Local Government and Communities Committee.

About the Bill

The Bill included provision for:

  • prohibiting certain payments made in connection with the granting, renewal or continuance of standard occupation contracts;
  • the treatment of holding deposits.

Following the completion of Stage 2 proceedings, Stage 3 commenced on 30 November 2018.

Post-stage 4

The Renting Homes (Fees etc) (Wales) Bill was agreed by the Assembly in accordance with SO 12.36 on 27 March 2019. The 28 day period during which the Counsel General or the Attorney General may refer the Bill to the Supreme Court for a decision on its competence began on 28 March 2019. During this period the Secretary of State for Wales may also make an order prohibiting the submission of the Bill for Royal Assent. The 28 day period ended on 25 April 2019.

The Solicitor General, on behalf of the Attorney General, the Counsel General, and the Secretary of State for Wales wrote to the Presiding Officer to advise that they would not be referring the Renting Homes (Fees etc.) (Wales) Bill to the Supreme Court under Section 112 or 114 of the Government of Wales Act 2006.
